Terms for Account Holders
TERMS AND CONDITIONS FOR ACCOUNT HOLDERS
Effective Date: 13/03/2025
Welcome to Burrum Landscape Supplies. These Terms and Conditions apply to all customers who hold a trade account with us, allowing them to take stock and pay at a later date. By opening a trade account and making purchases under these terms, you agree to abide by the following conditions:
1. Account Eligibility & Approval
1.1 Trade accounts are available to approved businesses and individuals at the discretion of Burrum Landscape Supplies. 1.2 Approval of a trade account is subject to credit checks and other verification procedures as deemed necessary. 1.3 Burrum Landscape Supplies reserves the right to refuse, suspend, or terminate an account at any time.
2. Payment Terms
2.1 Payments are due within 14 days from the invoice date unless otherwise agreed in writing. 2.2 All payments must be made via bank transfer, credit card, or other approved payment methods as specified by Burrum Landscape Supplies. 2.3 If a customer has multiple outstanding invoices, payments received will be applied to the oldest outstanding invoice first unless otherwise agreed.
3. Overdue Payments & Late Fees
3.1 Accounts exceeding 30 days past due will incur a late fee of 2% per month on the overdue balance. 3.2 Burrum Landscape Supplies reserves the right to suspend trade privileges for any account with overdue payments. 3.3 If an account remains overdue for 60 days or more, the account may be referred to a collections agency or legal action may be taken. 3.4 The customer will be liable for any costs associated with debt recovery, including legal fees and collection agency costs.
4. Ownership of Goods
4.1 All goods remain the property of Burrum Landscape Supplies until payment is received in full. 4.2 In the event of non-payment, Burrum Landscape Supplies reserves the right to reclaim unpaid goods without notice. 4.3 The customer agrees to store unpaid goods separately and in a manner that clearly indicates they remain the property of Burrum Landscape Supplies.
5. Delivery & Risk
5.1 Risk in the goods passes to the customer upon collection from our premises or upon delivery to the customer’s specified location. 5.2 Burrum Landscape Supplies is not responsible for any loss, damage, or delay in delivery beyond our control. 5.3 Customers must inspect goods upon delivery and notify Burrum Landscape Supplies of any discrepancies or defects within 48 hours.
6. Returns & Refunds
6.1 Goods can only be returned if they are faulty, damaged, or incorrectly supplied. 6.2 Returns must be requested within 7 days of purchase and be accompanied by proof of purchase. 6.3 Burrum Landscape Supplies reserves the right to refuse returns or charge a restocking fee where applicable.
7. Warranty & Liability
7.1 Burrum Landscape Supplies provides no warranties beyond those required by Australian Consumer Law. 7.2 Burrum Landscape Supplies is not liable for any damage, loss, or injury resulting from the improper use, handling, or installation of products. 7.3 Customers acknowledge that natural variations in color, texture, and composition are inherent in landscape materials and do not constitute defects.
8. Account Termination & Suspension
8.1 Burrum Landscape Supplies reserves the right to terminate or suspend trade accounts at its discretion. 8.2 Accounts may be terminated due to non-payment, breach of these terms, or if the account is inactive for an extended period. 8.3 Customers may request account closure at any time, provided all outstanding balances are settled in full.
9. Privacy & Data Protection
9.1 Customer information is collected and stored in accordance with our Privacy Policy. 9.2 Burrum Landscape Supplies will not share customer information with third parties except as required by law or for debt recovery purposes.
10. Changes to Terms & Conditions
10.1 Burrum Landscape Supplies reserves the right to modify these Terms and Conditions at any time. 10.2 Customers will be notified of any significant changes, and continued use of the account constitutes acceptance of the updated terms.
